Apostille Ontario — Document Legalization & Authentication

Ontario is one of the provinces with its own designated competent authority under the Apostille Convention, which Canada joined effective 11 January 2024. Apostilles for Ontario documents are issued by Official Documents Services (ODS), part of the Ministry of Public and Business Service Delivery, in Toronto. ODS handles documents issued in Ontario as well as documents notarized in Ontario — a wide mandate that covers most of what residents of the province typically need certified for use abroad.

Federal documents follow a different path. An RCMP criminal record check, a federal certificate of incorporation, or any other federally issued document goes to Global Affairs Canada for its apostille or authentication regardless of where in Canada you live. Many Ontario files mix both streams — for example, a provincial birth certificate alongside an RCMP check — so knowing which authority takes which document is the first practical question in every file.

As Canada's most populous province, Ontario generates a constant flow of documents bound for foreign authorities. Newcomers across the Greater Toronto Area settle inheritance, property, and civil-status matters in their countries of origin. Graduates of the University of Toronto, Western, Waterloo, Queen's, and McMaster take degrees and transcripts abroad for further study or licensing. Companies from Toronto's financial core to the manufacturing belt around Hamilton and Windsor certify corporate records for foreign registrations and cross-border contracts.

Individual life events drive just as much of the demand: marriage abroad, a teaching contract overseas, dual-citizenship registration for a child, or a power of attorney for a relative managing affairs in another country. In each case the receiving authority — not the document type — determines whether an apostille is the right instrument at all.

Vital records such as birth, marriage, and death certificates should be ordered as official certified copies through ServiceOntario rather than presented as photocopies. Original government-issued records generally qualify for an apostille directly.

Documents that are not government-issued — diplomas, reference letters, consent letters, corporate resolutions, copies of passports — usually need to be notarized by an Ontario notary public or, in some cases, certified by a commissioner of oaths before ODS will act on them. Because ODS accepts documents notarized anywhere in Ontario, a properly notarized document from Thunder Bay is treated the same as one from downtown Toronto.

An apostille is only the correct route when the destination country is a party to the Apostille Convention. For member destinations — most of Europe and Latin America, and a growing list elsewhere — the apostille from ODS or Global Affairs Canada completes the certification.

For countries that are not Convention members, such as the United Arab Emirates, Qatar, and Kuwait, the older two-step route still applies: authentication first, followed by consular legalization at the destination country's embassy or consulate in Canada.
